1. Acceptance of Terms

Welcome to Talentisle (talentisle.com), a job portal service operated by Ziveka PVT Ltd (Business Registration Number PV00344833). By accessing or using our platform, you agree to be bound by these Terms and Conditions, our Privacy Policy, and all applicable laws and regulations. If you do not agree with any of these terms, please do not use our services.

2. Definitions

“Platform” refers to the Talentisle website, mobile applications, and all related services.

“User,” “You,” or “Your” refers to any individual or entity accessing or using our services.

“Job Seeker” refers to users who register to search and apply for employment opportunities.

“Employer” refers to companies, organizations, or individuals who register to post job vacancies and recruit candidates.

“Content” includes all information, text, images, data, links, software, or other material accessible through the Platform.

“We,” “Us,” or “Our” refers to Talentisle and Ziveka.

3. Eligibility and Registration

3.1 You must be at least 18 years old to use this Platform.

3.2 You must provide accurate, current, and complete information during registration and maintain the accuracy of such information.

3.3 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.4 Employers must provide valid business registration documents and undergo verification before posting job vacancies.

3.5 You agree to notify us immediately of any unauthorized use of your account.

3.6 We reserve the right to refuse registration, suspend, or terminate accounts that violate these Terms or engage in fraudulent or illegal activities.

4. User Conduct

4.1 Job Seekers agree to:

  • Provide truthful and accurate information in profiles, CVs, and applications
  • Not misrepresent qualifications, experience, or credentials
  • Not apply for positions with fraudulent documents
  • Respond professionally to employer communications
  • Not use the Platform for any purpose other than seeking legitimate employment

4.2 Employers agree to:

  • Post only genuine job vacancies with accurate information
  • Not discriminate based on race, religion, gender, age, disability, or any protected characteristic
  • Not request illegal or inappropriate information from candidates
  • Respond to applications in a timely and professional manner
  • Not use candidate information for purposes other than recruitment
  • Honor salary ranges and benefits mentioned in job postings
  • Not charge candidates any fees for job opportunities

4.3 All Users agree not to:

  • Use the Platform for illegal purposes or in violation of any laws
  • Post or transmit harmful, offensive, defamatory, or obscene content
  • Harvest or collect user data without authorization
  • Interfere with or disrupt the Platform’s operation or security
  • Create multiple accounts for fraudulent purposes
  • Impersonate any person or entity
  • Engage in any form of harassment or spam
  • Attempt to gain unauthorized access to any portion of the Platform

5. Job Postings and Applications

5.1 All job postings must comply with Sri Lankan employment laws and regulations.

5.2 We reserve the right to review, edit, or remove any job posting that violates these Terms or applicable laws.

5.3 Employers are responsible for the accuracy and legality of their job postings.

5.4 Job Seekers submit applications at their own discretion and risk. We do not guarantee job placement or interviews.

5.5 Applications submitted through the Platform are delivered directly to the respective employers.

5.6 We are not party to any agreement between Job Seekers and Employers resulting from Platform use.

6. Verification and Monitoring

6.1 We employ reasonable measures to verify employer legitimacy but do not guarantee the authenticity of all postings.

6.2 We reserve the right to investigate suspicious activities and take appropriate action.

6.3 Users should exercise due diligence and report suspicious postings or conduct to our support team.

6.4 We may monitor communications on the Platform to ensure compliance with these Terms and prevent fraudulent activity.

7. Intellectual Property Rights

7.1 All content on the Platform, including text, graphics, logos, interfaces, and software, is the property of Talentisle/Ziveka or its licensors and is protected by intellectual property laws.

7.2 Users retain ownership of content they submit (CVs, cover letters, etc.) but grant us a non-exclusive, worldwide license to use such content for providing and improving our services.

7.3 You may not reproduce, modify, distribute, or create derivative works from any Platform content without our express written permission.

7.4 The Talentisle name, logo, and related marks are trademarks of Ziveka and may not be used without permission.

8. Privacy and Data Protection

8.1 Our collection, use, and protection of personal data are governed by our Privacy Policy, which complies with the Personal Data Protection Act No. 9 of 2022 of Sri Lanka.

8.2 By using the Platform, you consent to our data practices as described in our Privacy Policy.

8.3 We implement appropriate security measures to protect user data but cannot guarantee absolute security.

8.4 You are responsible for maintaining the security of your own devices and internet connections.

9. Fees and Payments

9.1 Job Seekers may use basic Platform features free of charge.

9.2 Employers must pay applicable fees for posting job vacancies and accessing premium features.

9.3 All fees are quoted in Sri Lankan Rupees (LKR) unless otherwise specified.

9.4 Payment terms and refund policies are available upon request and may vary based on chosen services.

9.5 We reserve the right to modify fees with reasonable notice to users.

10. Third-Party Links and Services

10.1 The Platform may contain links to third-party websites or services not owned or controlled by us.

10.2 We have no control over and assume no responsibility for third-party content, privacy policies, or practices.

10.3 You acknowledge and agree that we shall not be liable for any damage arising from use of third-party sites or services.

10.4 We encourage you to read the terms and privacy policies of any third-party sites you visit.

11. Disclaimers and Limitation of Liability

11.1 The Platform Is Provided “As Is” And “As Available” Without Warranties Of Any Kind, Either Express Or Implied.

11.2 We Do Not Warrant That The Platform Will Be Uninterrupted, Error-Free, Secure, Or Free From Viruses Or Harmful Components.

11.3 We Do Not Guarantee The Accuracy, Completeness, Or Usefulness Of Any Information On The Platform.

11.4 We Are Not Responsible For The Conduct Of Any User, Whether Online Or Offline.

11.5 We Do Not Verify The Identity Or Background Of Users And Make No Representations About The Safety Of Using The Platform.

11.6 To The Maximum Extent Permitted By Law, We Shall Not Be Liable For Any Indirect, Incidental, Special, Consequential, Or Punitive Damages, Including Loss Of Profits, Data, Or Opportunities.

11.7 Our Total Liability For Any Claims Arising From Use Of The Platform Shall Not Exceed The Amount Paid By You, If Any, For Accessing The Platform In The Twelve Months Preceding The Claim.

11.8 Some jurisdictions do not allow limitation of liability for incidental or consequential damages, so these limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Talentisle, Ziveka, and our affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your conduct in connection with the Platform

13. Termination

13.1 You may terminate your account at any time by contacting our support team.

13.2 We may suspend or terminate your account immediately, without prior notice, if you:

  • Violate these Terms or applicable laws
  • Engage in fraudulent, abusive, or harmful conduct
  • Provide false information
  • Fail to pay applicable fees (for Employers)

13.3 Upon termination, your right to use the Platform ceases immediately.

13.4 Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Dispute Resolution

14.1 These Terms shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka.

14.2 Any disputes arising from these Terms or use of the Platform shall first be attempted to be resolved through good-faith negotiations.

14.3 If negotiations fail, disputes shall be submitted to the exclusive jurisdiction of the courts of Colombo, Sri Lanka.

15. Modifications to Terms

15.1 We reserve the right to modify these Terms at any time at our sole discretion.

15.2 We will notify users of material changes by posting the updated Terms on the Platform and updating the “Last Updated” date.

15.3 Significant changes may also be communicated via email to registered users.

15.4 Your continued use of the Platform after changes take effect constitutes acceptance of the modified Terms.

15.5 If you do not agree to modify Terms, you must discontinue use of the Platform.

16. General Provisions

16.1 Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Talentisle regarding use of the Platform.

16.2 Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16.3 Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16.4 Assignment: You may not assign or transfer these Terms or your account without our prior written consent. We may assign our rights and obligations without restriction.

16.5 Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, civil unrest, government actions, or technical failures.

17. Compliance with Sri Lankan Laws

17.1 All users must comply with:

  • The Personal Data Protection Act No. 9 of 2022
  • The Computer Crimes Act No. 24 of 2007
  • The Employment Acts and Labour Laws of Sri Lanka
  • All other applicable laws and regulations

17.2 Employers must adhere to:

  • The Shop and Office Employees Act
  • The Minimum Wages Ordinance
  • Equal opportunity and anti-discrimination laws
  • All relevant labour regulations

17.3 Violations of Sri Lankan laws through use of the Platform may result in immediate account termination and reporting to relevant authorities.
